Agreement to Terms

By accessing this website or engaging Marin Cole Studio for photography services, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or our services.

Photography Services

• All bookings are confirmed upon receipt of a signed contract and deposit. A verbal or email agreement does not constitute a confirmed booking
• Session details, pricing, and deliverables are defined in your individual booking contract, which takes precedence over these general terms
• We reserve the right to decline or cancel a booking at our discretion, in which case any deposits paid will be refunded in full
• Rescheduling is subject to availability and the terms in your booking contract

Deposits and Payments

• A non-refundable deposit is required to secure your date. The deposit amount is stated in your booking contract
• The remaining balance is due on or before the agreed date specified in your contract
• Prices are quoted in US dollars. Payment methods are outlined in your booking contract
• Late payment may result in a delay in gallery delivery or cancellation of services

Cancellations

• Deposits are non-refundable as they compensate us for holding your date and declining other bookings
• Cancellations made more than 90 days before the event: deposit forfeited, remaining balance not owed
• Cancellations made 30–90 days before the event: 50% of the remaining balance is owed
• Cancellations made fewer than 30 days before the event: 100% of the remaining balance is owed
• We strongly recommend event insurance that covers photography vendor cancellation

Delivery of Images

• Edited images are delivered via an online gallery within the timeframe stated in your booking contract (typically 6–10 weeks for weddings, 2–3 weeks for other sessions)
• The number of images delivered is an estimate; the final count may vary based on the session
• Gallery download links are valid for 12 months. We recommend downloading and backing up your images promptly
• We are not responsible for images lost after gallery expiry or due to hardware failure on your end

Intellectual Property & Licence

Marin Cole Studio retains the copyright to all photographs. Upon full payment, clients receive a personal use print licence.

• Personal use licence includes: printing for personal use, sharing on personal social media with credit, and display in personal spaces
• Commercial use requires a separate commercial licence agreement — contact us before using images in advertising, editorial, or business contexts
• We may use images for portfolio, marketing, and editorial purposes unless you request otherwise in writing before your session

Limitation of Liability

In the unlikely event of equipment failure, illness, or circumstances beyond our control, our liability is limited to a refund of amounts paid. We are not liable for indirect, consequential, or incidental damages. We carry professional liability insurance and will always do our utmost to deliver your images.

Website Use

All content on this website — including text, images, and design — is owned by Marin Cole Studio or its licensors. You may not reproduce, distribute, or use our content for commercial purposes without written permission.

Governing Law

These terms are governed by the laws of the State of Oregon. Any disputes shall be resolved in the courts of Multnomah County, Oregon. We encourage you to contact us first at hello@marincolestudio.com before pursuing other remedies.

Changes to Terms

We may update these Terms of Service from time to time. The effective date above will reflect the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
